Omake Digital Card Terms and Conditions

These Card Terms govern the diner QR and restaurant enrollment card shown in the Omake App (each a "Digital Card"). By enrolling at a Merchant, including via a /r/ link or a staff scan, you agree to these Card Terms, the Application Terms, the Rewards Terms, and the Privacy Policy.

1. Definitions

Digital Card means the in-app restaurant card and the scannable diner QR that identifies your loyalty account. Omake uses one diner QR for every Merchant. Merchant, Member, Points, and App have the meanings in the Rewards Terms.

2. Nature of the Digital Card

2.1 Not a financial instrument. The Digital Card is a loyalty identifier and interface for scanning a QR at a Merchant counter.

2.2 No stored value. It is not a credit, debit, gift, or prepaid card. It holds no money, cannot be bought or sold, and cannot process payments.

2.3 Prepaid-card rules. Because it holds no monetary value and costs nothing to obtain, it is not a prepaid card under the Consumer Protection Act (Quebec).

3. Issuance

Enrollment is free. The App shows the Merchant name, your name, and your balances for that Merchant. Your diner QR does not change from restaurant to restaurant.

4. Use and non-transferability

Digital Cards live only in the Omake App. They cannot be exported to Apple Wallet or Google Pay. You may not sell or assign your QR to another account. You remain responsible if someone else presents your device at the counter.

5. Recovery

Deleting the App does not delete your account or cards. Reinstall and sign in with the same method (email, Apple, or Google) to recover them.

6. Deactivation

A card at a Merchant may deactivate after twelve (12) months of inactivity, with 30 to 60 days' written notice. Deleting your Omake account deactivates every Digital Card and forfeits remaining balances, subject to records we must keep (see the Privacy Policy).

7. Fraud

Manipulating balances, duplicating QR codes, or defrauding a Merchant is a material breach. We may suspend or revoke cards and refer serious fraud to law enforcement.
