Omake General Application Terms of Service

These General Application Terms of Service (the "Terms") are an agreement between you ("Member", "you") and Kouvre Inc. ("Kouvre", "we"), operating the Omake mobile application (the "App").

By downloading, registering for, or using the App, you agree to these Terms and to our Rewards Terms, Digital Card Terms, and Privacy Policy.

1. Definitions

App means the Omake mobile application and associated digital platforms. Member means a person who has registered an account. Merchant means an independent restaurant or business that hosts a loyalty program on Omake. Rewards Milestone means a product or offer set by a Merchant.

2. Eligibility and account

2.1 Age. You must be at least fourteen (14) years of age. By registering, you represent that you meet this requirement. If we learn a user is under 14, we will terminate the account and delete personal information as required by Quebec law.

2.2 Account security. You are responsible for your login credentials and must notify us of unauthorized use at [email protected].

3. Licence to use the App

3.1 Limited licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on a device you own or control, for personal, non-commercial use.

3.2 Screenshots. You may screenshot your diner QR, balances, and rewards to share with friends. Interactive or social features added later remain subject to these Terms.

3.3 Intellectual property. Kouvre retains all rights in the App and the Omake name. Merchant logos and branding remain the Merchant's property.

4. Prohibited conduct

You agree not to reverse engineer the App; use bots or scrapers; invent or manipulate balances, QR codes, or receipts; or use the App for any illegal purpose.

5. App Store disclaimers

These Terms are between you and Kouvre, not Apple Inc. or Google LLC. Kouvre is solely responsible for the App. Apple and Google have no maintenance obligation. If you downloaded the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms.

6. Disclaimer and liability

6.1 As-is. To the extent permitted by the Civil Code of Quebec and the Consumer Protection Act (Quebec), the App is provided as-is.

6.2 Merchants. Kouvre is a technology intermediary. We do not operate Merchants and are not liable for their food, service, or failure to honour a reward, or for a Merchant closing.

6.3 Cap. Except for our own gross fault or intentional misconduct, our total liability to you is limited to fifty Canadian dollars ($50.00 CAD).

7. Amendments

We may amend these Terms. If an amendment increases your obligations or reduces ours, we will give at least thirty (30) days' written notice under the Consumer Protection Act (Quebec), including your right to refuse and close your account without cost within thirty (30) days after the amendment takes effect.

8. Governing law

These Terms are governed by the laws of Quebec and the federal laws of Canada applicable there. Courts of the judicial district of Montreal have exclusive jurisdiction.
